This writ of scire facias was issued by the Third District Court in Fort Scott, Kansas Territory to Cain (first name unknown) and John Riggs on May 22, 1860. Cain had been previously arrested for the crime of larceny on Native American land and released on bond, or recognizance, with John Riggs listed as secondary party. The writ states Cain failed to appear for his trial during the May court term of 1860, thus breaking the conditions of the bond. The writ orders Cain and Riggs to appear in court and explain why a final judgement should not be made against them.
