This case file relates to the charge against David Allen for trespass on Indian lands on May 1, 1858 in Johnson County, Kansas Territory. The indictment of Allen in October of 1858 by the 2nd District Court states that he is accused of destroying timber and trees worth $20 on Indian land that is the property of the U.S. government. The influx of white settlers beginning in 1854 with the passage of the Kansas-Nebraska act resulted in increased encroachment on and destruction of property and lands promised to a large variety of Indian nations. Allen was arrested on March 27, 1860 and released on bond on March 28, with his trial scheduled for May 28, 1860.
